TERMS AND CONDITIONS

Definitions:

Eligible Entrant: means a person who meets the eligibility criteria outlined in clauses 2, 3 and 4.  

Immediate Family Member: means a spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1^st cousin.

Minor Weekly Prize: means the prizes as set out in clause 9.

Minor Weekly Prize Draw: means the weekly draws for the Minor Weekly Prize conducted during the Minor Weekly Prize Draw Period.

Minor Weekly Prize Draw Period: means each of the following periods:

Participating Venue: means any Timezone or Zone Bowling venue located in New Zealand.

Prize: means the prizes to be awarded pursuant to this Promotion, consisting of the Minor Weekly Prize.

Promoter: means TEEG NZ Limited (NZBN 9429038327261) of Level 4, 5-7 Kingdon Street, Newmarket, Auckland, 1024.

Promotion: means the “Timezone & Zone Bowling Play to Win (Minor Prize Draw) Competition” governed by these terms and conditions.

Promotional Period: means the period commencing on Monday 1 July at 00:01 NZST and ending on Sunday 28 July at 23:59 NZST.

Qualifying Transaction: means a transaction during the Promotional Period pursuant to which an Eligible Entrant successfully loads credit onto a Registered Powercard at a Participating Venue or in-app via the Timezone Fun App (available for download via the App Store or Google Play).  

Registered Powercard: means a Powercard issued by a Participating Venue which is registered in a Participating Venue or in-app via the Timezone Fun App on or before the date of that Qualifying Transaction.

Terms and Conditions:

 

1. Participation in this Promotion constitutes deemed acceptance of these terms and conditions.

2. This Promotion is open to New Zealand residents aged 18 years and above who are not employees, or an Immediate Family Member of an employee, of either the Promoter or any agency associated with this Promotion. An entry by an employee, or an Immediate Family Member of an employee, of either the Promoter or an agency associated with this Promotion will be treated as invalid, resulting in the forfeiture of any prize awarded to that person in connection with this Promotion.

3. An Eligible Entrant may enter the Promotion by making a Qualifying Transaction during the Promotional Period and must provide their email address when making the Qualifying Transaction or associate their email address to their Timezone Fun App account on or before the date of that Qualifying Transaction. Following the completion of each such Qualifying Transaction, the Eligible Entrant will be automatically entered into the Promotion and receive one (1) entry into the corresponding Minor Weekly Prize Draw for that corresponding Minor Weekly Prize Draw Period for each Qualifying Transaction (e.g. if an Eligible Entrant makes a Qualifying Transaction in Week 2, then that Eligible Entrant will receive one (1) entry into the Minor Weekly Prize Draw for Week 2).

4. Eligible Entrants are permitted to make multiple Qualifying Transactions during the Promotional Period. Each valid Qualifying Transaction will result in one (1) entry into the Minor Weekly Prize Draw for that corresponding Minor Weekly Prize Draw Period (e.g. if an Eligible Entrant makes two Qualifying Transactions in Week 2, then that Eligible Entrant will receive two (2) entries into the Minor Weekly Prize Draw for Week 2).

5. Eligible Entrants that make a Qualifying Transaction:

1. 1. at a Participating Venue must retain the purchase receipt; and
   2. in-app via the Timezone Fun App must retain the confirmation email issued in respect of the transaction, as proof of purchase.

Failure to produce the proof of purchase when requested by the Promoter may, in the reasonable discretion of the Promoter, result in automatic forfeiture of any Prize awarded.

6. The Promoter reserves the right, at any time, even if a person has made a Qualifying Transaction, to verify any details regarding that person’s eligibility, including the validity of the Qualifying Transaction and the identity of any person purporting to enter the Promotion (including their age and place of residence). The Promoter reserves the right, in its sole discretion, to disqualify any person who is unable to produce satisfactory proof of identity or who the Promoter has reason to believe has breached any of these terms and conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Promotion. Failure by the Promoter to enforce any of its rights does not constitute a waiver of those rights. The Promoter's rights to recover damages or other compensation from such persons are reserved at all times.

7. There will be one (1) Minor Weekly Prize Draw (with a total of four (4) sequential draws during the Promotional Period) conducted for each corresponding Weekly Period as set out in the Minor Weekly Prize Draw Period table.

8. All Minor Weekly Prize Draws will take place at Level 4 Kingdon Street, Newmarket, Auckland, 1024 on the dates and times below:

9. On each of the above Draw Dates, five (5) draws will take place in the order as set out in the below table. During each of the five (5) draws, Eligible Entrants will be randomly drawn to win one Prize each. The number of Eligible Entrants drawn, and the corresponding Prize to be won by each drawn Eligible Entrant, during each Minor Weekly Prize Draw Period are set out in the below table:

10. An Eligible Entrant may win multiple Prizes during the Promotional Period subject to the following conditions:

1. 1. If an Eligible Entrant wins a Prize during a Minor Weekly Prize Draw, then that Eligible Entrant is not eligible to win that same prize or any other Prize during that respective Minor Weekly Prize Draw; and
   2. An Eligible Entrant may still win a Prize in any subsequent Minor Weekly Prize Draw provided that same prize has not already been won by that Eligible Entrant in any other Minor Weekly Prize Draw during the Promotional Period (e.g. If an Eligible Entrant wins a $100 Powercard Arcade Credit in the Minor Weekly Prize Draw for Week 1, it will not be eligible to win another $100 Powercard Arcade Credit in any subsequent Minor Weekly Prize Draw but may still win a different Prize).

11. Minor Weekly Prize Draw winners will be notified by the Promoter within five (5) business days of the corresponding Draw Date (“Notification Date") to the email address associated to that Eligible Entrant’s Timezone Fun App account or provided by that Eligible Entrant when making the Qualifying Transaction. Each winner consents to the publication of their name online at https://www.zonebowling.com/en-nz/competitions/ and https://www.timezonegames.com/en-nz/competitions unless indicated otherwise by email to the Promoter prior to the date of publication.

12. The Minor Weekly Prize Draw winners will each receive an email containing a voucher with a unique code and instructions on how to redeem that voucher for the Prize subject to the following conditions:

1. 1. Powercard Arcade Credits – voucher must be redeemed by the winner at a Participating Venue or in-app via the Timezone Fun App within thirty (30) days from the date that the voucher was issued by the Promoter to the winner’s nominated email address. Arcade credits must be loaded onto a single Powercard and can be used at any Participating Venue. Arcade Credits loaded onto the Powercard will expire within one (1) year from the date of last use of that Powercard; and
   2. 30 Minutes Time Play Voucher – voucher must be presented and redeemed at a Participating Venue for 30 minutes of Time Play on Red and Yellow card reader games only. Voucher must be redeemed by the winner within thirty (30) days from the date that the voucher was issued by the Promoter to the winner’s nominated email address; and
   3. Exclusive Timezone branded plush toy – voucher must be presented and redeemed at a Participating Venue for one exclusive Timezone branded plush toy to be collected at that Participating Venue. Voucher must be redeemed by the winner within thirty (30) days from the date that the voucher was issued by the Promoter to the winner’s nominated email address.

13. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.

14. If, for any reason, a winner does not redeem and/or use a Prize (or an element of a prize) at or by the time stipulated under these terms and conditions, then the Prize (or that element of the prize) will be automatically and immediately forfeited and the winner cannot make a claim against the Promoter as a result of such forfeiture.

15. If any Prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize with a prize of an equal or greater value and/or specification, subject to any written directions from a regulatory authority.

16. Each Eligible Entrant consents to the Promoter using their name, likeness, image and/or voice in the event they are a winner in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any goods or services provided by the Promoter.

17. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to forced government closures, technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any person; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

18. Any cost (such as internet service provider costs) associated with accessing the Promoter’s website and/or app is the Eligible Entrants’ responsibility.

19. Nothing in these terms and conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Consumer Guarantees Act 1993 (NZ) as well as any other implied warranties under consumer protection laws in New Zealand (“Non-Excludable Guarantees”).

20. Except for any liability that cannot by law be excluded, including any liability arising from a breach of the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including in negligence), for any injury, loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of or in connection with this Promotion, including but not limited to: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) a Prize claim that is late, lost, altered, damaged or misdirected (whether or not after receipt by the Promoter) except where directly caused by the Promoter; (d) any tax liability incurred by an Eligible Entrant as a result of this Promotion; or (e) in connection with the redemption or use of a Prize.

21. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to New Zealand regulatory authorities. The Promoter will also use, and handle PI as set out in its Privacy Policy, which can be viewed at https://www.timezonegames.com/en-nz/privacy/, https://www.zonebowling.com/en-nz/privacy/. In addition to any use that may be outlined in the Promoter’s Privacy Policy, if an Eligible Entrant has opted in at the time of registering a Timezone account or of completing an Eligible Transaction, the Promoter may, unless otherwise advised by the Eligible Entrant, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Eligible Entrant. The Privacy Policy also contains information about how Eligible Entrants may opt out, access, update or correct their PI, how Eligible Entrants may complain about a breach of the Privacy Act, the Principles or any other applicable law and how those complaints will be dealt with. The Promoter may disclose PI outside of New Zealand. Eligible Entrant: means a person who meets the eligibility criteria outlined in clauses 2, 3 and 4.  

Grand Prize: means, at the election of the winner, either:

• a family holiday for four (4) people to Queenstown, New Zealand (‘Queenstown Holiday’) comprising:

1. 1. return economy airfares for the winner and up to three (3) companions from any of Auckland, Christchurch or Wellington to and from Queenstown, New Zealand;
   2. four (4) nights’ accommodation at a five-star hotel or resort for up to four (4) people in Queenstown, New Zealand;
   3. one-day lift and basic ski or snowboard rental package for up to four (4) people at Treble Cone ski field;
   4. a scenic helicopter flight for up to four (4) people;
   5. a hot air balloon flight for up to four (4) people;
   6. a one-hour spa or onsen pool experience for up to four (4) people;
   7. Kingpin Gold Passes for up to four (4) people for use at Kingpin Queenstown; and
   8. NZD$5,000 spending money; or

• NZD$20,000.00 which must be transferred to a bank account held with a registered bank in New Zealand.

Grand Prize Draw: means the draw for the Grand Prize that is to be conducted in accordance with clause 13.

Immediate Family Member: means a spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1^st cousin. 

Major Weekly Prize: means the weekly prizes as set out in clause 9.

Major Weekly Prize Draw: means the weekly draws for the Major Weekly Prize conducted during the Major Weekly Prize Draw Period.

Major Weekly Prize Draw Period: means each of the following periods:

5. successfully completes a telephone booking made through the Zone Bowling or Kingpin Guest Services centre other than a group and corporate booking.

Each transaction which conforms with this definition will be considered a single Qualifying Transaction irrespective of how many products, goods or services are comprised in that transaction.

Registered Powercard: means a Powercard issued by a Participating Venue which is registered in a Participating Venue or in-app via the Timezone Fun App on or before the date of that Qualifying Transaction.

11. An Eligible Entrant may win multiple Major Weekly Prizes during the Promotional Period provided that the same prize has not already been won by that Eligible Entrant in any other Major Weekly Prize Draw during the Promotional Period (e.g. If an Eligible Entrant wins an iPhone 15 128 GB in the Major Weekly Prize Draw for Week 1, it will not be eligible to win another iPhone 15 128GB in any subsequent Major Weekly Prize Draw but may still win a different Major Weekly Prize).
12. Major Weekly Prize Draw winners will be notified by the Promoter within five (5) business days of the corresponding Draw Date (“Notification Date") to the email address associated to that Eligible Entrant’s Timezone Fun App account or provided by that Eligible Entrant when making the Qualifying Transaction. Each winner consents to the publication of their name online at https://www.timezonegames.com/en-nz/competitions/,https://www.kingpinplay.com/en-nz/competitions/, https://www.zonebowling.com/en-nz/competitions/

unless indicated otherwise by email to the Promoter prior to the date of publication. Each winner has twenty (20) business days from the Notification Date to accept the Major Weekly Prize by emailing their acceptance to the Promoter’s email address provided to them.  Once the Major Weekly Prize is accepted, the Promoter will contact the winner by email to arrange delivery of that Major Weekly Prize to the winner. The winner must provide their delivery address by email within two (2) weeks of the Promoter contacting the winner to arrange delivery. All deliveries with respect to the Major Weekly Prizes must be made to a New Zealand address.  

12. The total prize pool value for the Major Weekly Prizes is valued at NZD$ 32. The Major Weekly Prizes are not transferable or exchangeable and cannot be taken as cash.

13. The Grand Prize Draw will take place at Level 4, 5-7 Kingdon Street, Newmarket, Auckland, 1024 on Wednesday 31 July 2024 at 11:00 NZST. The Promoter reserves the right to conduct further draws for the Grand Prize and record them should an invalid or ineligible entry be drawn. The winner of the Grand Prize will be notified by the Promoter within five (5) business days of the date of the Grand Prize draw to the email address associated to that Eligible Entrant’s Timezone Fun App account or provided by that Eligible Entrant when making the Qualifying Transaction. The winner has twenty (20) business days from the date of notification to provide the Promoter with notice in writing:

1. 1. accepting the Grand Prize; and
   2. electing to redeem either the Queenstown holiday described in the definition of ‘Grand Prize’ or NZD$20,000; and
   3. confirming the airport and date of departure if the winner elects to redeem the Queenstown holiday; or
   4. confirming the details of the New Zealand bank account to which the NZD$20,000 should be transferred and a phone number that can be used to verify those bank account details.

    https://www.zonebowling.com/en-nz/competitions/ unless indicated otherwise by email to the Promoter prior to the date of publication.

15. The Queenstown Holiday is subject to the following additional conditions:

1. 1. travel must occur on or prior to 31 October 2024;
   2. if any component of the Queenstown Holiday is unavailable, the Promoter, in its discretion, reserves the right to substitute that component with an alternative of an equal or greater value and/or specification, subject to any written directions from a regulatory authority;
   3. the Promoter will not be liable for any costs, expenses, activities or items incurred or purchased by the winner which are not expressly included in paragraph (a) of the definition of ‘Grand Prize’;
   4. each component of the Queenstown Holiday is to be provided by a third party and may therefore be subject to terms and conditions imposed by that third party;
   5. the Promoter’s sole obligation is to arrange and pay for the components of the Queenstown Holiday on the winner’s behalf. The Promoter is not liable for, and the winner hereby releases the Promoter from, any claim, cost, liability, loss or expense arising from or in connection with the Queenstown Holiday; and
   6. any component of the Queenstown Holiday which the winner elects not to utilise will be forfeited and cannot be transferred, exchanged or redeemed for cash.

16. The Grand Prize is valued at up to NZD$20,000. The Grand Prize can only be redeemed by the winner and is not transferrable or exchangeable.

17. If, for any reason, a winner does not take and/or redeem a Prize in accordance with and by the time stipulated under these terms and conditions, then the Prize will be automatically and immediately forfeited and the winner cannot make a claim against the Promoter as a result of such forfeiture. If a Prize is forfeited pursuant to this clause, an unclaimed prize draw will be conducted pursuant to clause 18.

18. If a Prize is not claimed by the winner and is forfeited pursuant to clause 17, a further draw will take place on 19 September 2024 at the same time and place as the original draw, subject to any directions from a regulatory authority. The winner of the draw will be notified within five (5) business days of the draw (“Redraw Notification Date”) to the email address associated to that Eligible Entrant’s Timezone Fun App account or provided by that Eligible Entrant when making the Qualifying Transaction. If there are any Prizes awarded as a result of a draw conducted in accordance with this clause, then, then the winner of each such Prize (each a “Redraw Winner”) consents to their name being published online at https://www.timezonegames.com/en-nz/competitions/, https://www.kingpinplay.com/en-nz/competitions/
    https://www.zonebowling.com/en-nz/competitions/ unless indicated otherwise by  email to the Promoter  prior to the date of publication. Each Redraw Winner has twenty (20) business days from the Redraw Notification Date to accept their Prize by emailing their acceptance to the Promoter’s email address provided to them. Once a Prize has been accepted, the Redraw Winner must deal directly with the Promoter as distributer of that prize and the respective terms and conditions (including any time stipulations) to redeem that prize shall apply. Additional unclaimed prize draws may occur three (3) months after the previous unclaimed prize draw until each Prize is claimed.

19. Each Eligible Entrant consents to the Promoter using their name, likeness, image and/or voice in the event they are a winner in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any goods or services provided by the Promoter.

20. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to forced government closures, technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any person; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

21. Any cost (such as internet service provider costs) associated with accessing the Promoter’s website and/or app is the Eligible Entrants’ responsibility.

22. Nothing in these terms and conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Consumer Guarantees Act 1993 (NZ) as well as any other implied warranties under consumer protection laws in New Zealand (“Non-Excludable Guarantees”).

23. Except for any liability that cannot by law be excluded, including any liability arising from a breach of the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including in negligence), for any injury, loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of or in connection with this Promotion, including but not limited to: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) a Prize claim that is late, lost, altered, damaged or misdirected (whether or not after receipt by the Promoter) except where directly caused by the Promoter; (d) any tax liability incurred by an Eligible Entrant as a result of this Promotion; or (e) in connection with the redemption or use of a Prize.

24. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to New Zealand regulatory authorities. In addition to any use that may be outlined in the Promoter’s Privacy Policy, if an Eligible Entrant has opted in at the time of registering a Timezone account or of completing an Eligible Transaction, the Promoter may, unless otherwise advised by the Eligible Entrant, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Eligible Entrant.
